Court of Rio de Janeiro recognizes the 2-year statute of limitation in flight delay also for moral damages

The Fourth Panel of Appeals of Rio de Janeiro recognized the 2-year statute of limitation, as set forth in Article 35 of the Montreal Convention, in a lawsuit in which it was claimed moral and material damages due to international flight delay, ruled favorable at first instance. After appeal by the airline, the indemnity for material damages was dismissed. After the filing of an Extraordinary Appeal based on Theme 210 of General Repercussion, the Appeals Panel retracted, and the indemnity for moral damages was also dismissed.
