CADE approves joint venture between Latam and Delta

On February 24, the Administrative Council for Economic Defense (CADE, in Portuguese) approved the joint venture agreement between Latam and Delta, which aims to combine the aerial networks of both companies. The companies will jointly explore air transport services for passengers and cargo on routes between the USA, Canada, and South American countries. The contract was signed between the companies in May last year, and then sent to the Council for evaluation. The general superintendence of the autarchy (SG/CADE) concluded that “there are no significant barriers in the target routes of the agreement in relation to airport infrastructure, there are no regulatory restrictions, and that there is a high rivalry between companies operating in the relevant market”. The advisor-reporter in the case, Luis Braido, also concluded that the transaction “does not imply the elimination of competition in a substantial part of the relevant market, does not create or reinforce a dominant position, and does not result in the domination of the relevant market for goods or services.” – https://valor.globo.com/empresas/noticia/2021/02/24/cade-aprova-joint-venture-entre-latam-e-delta.ghtml
