New Typology of Regulatory Acts from ANAC Comes into Effect

Internal Resolution #1, of January 20, 2026, with the new types of regulatory acts adopted by Brazil’s Civil Aviation Agency (ANAC), came into effect on February 2. Normative Instruction #23/2009, which until then established the typology, is revoked. The new resolution is based on Decree #12,002/2024. From now on, regulated entities, employees, and society have a clearer, more responsive regulatory environment aligned with best practices in public administration. There will be a reduction in informational asymmetries and legal uncertainty, easier research and access to acts, and strengthening of regulatory governance and institutional transparency. For regulated entities, the main novelty lies in the sub-typification of Ordinances according to their purpose, with emphasis on the Regulatory Ordinance. This act is intended to issue general and abstract rules that impact external agents, aiming to detail and guide the application of requirements set forth in Brazilian Civil Aviation Resolutions and Regulations (RBACs). The new classification provides greater clarity on the scope of regulatory acts and increases regulatory predictability. Internally, the most relevant change is the end of the use of normative instructions (INs) for internal matters — according to Decree #12,002/2024, INs can only be used for acts of a singular nature.
